THIS AGREEMENT between myself, the Client and the Coach Kristin Solomon, Founder and Lead Principal of Arts and Cultural Management and THINK WITH YOUR HEART INSTITUTE ONLINE
WHEREAS the Client desires to obtain the benefit of the services of the Coach, and the Coach desires to render such services on the terms and conditions set forth.
IN CONSIDERATION of the promises and other good and valuable consideration (the sufficiency and receipt of which are hereby acknowledged) the parties agree as follows:
The Coach agrees that she will at all times faithfully, industriously, and to the best of her skill, ability, experience and talents, perform all of the duties required of her for the course
2. Client Needs
Client is in need of coaching and strategies for their creative business.
3. Contractor Expertise
The Coach is a creative administrative professional with 20 years of experience in strategic planning, communications, marketing, development, photography, design, and creative project management. Holds a Master’s degree in Arts and Cultural Management.
4. Activities and Deliverables
The Coach will meet with the Client in a group with other artists once a week via Zoom over the course of 12 weeks to discuss weekly lessons provided in the Creative Business Foundations Online Course.
5. Satisfaction Guarantee
THINK WITH YOUR HEART INSTITUTE ONLINE does not offer any complete refunds. We do offer a satisfaction guarantee. If you complete all the modules and attend and engage in all the meetings for the first 4 weeks of the course and are still not satisfied with the program, we will return 2/3 of your payment initial full payment or if paying on a plan, we will retain the first installment and cancel the remaining two payments.
The laws of the States of Oregon shall govern this agreement.
The parties hereto agree that in the event any article or part thereof of this agreement is held to be unenforceable or invalid then said article or part shall be struck and all remaining provision shall remain in full force and effect.
8. Group Rules
The Client agrees to create a welcoming environment and treat everyone int he group with respect. To ensure everyone feels safe, bullying of any kind isn't allowed, and degrading comments about things like race, religion, culture, sexual orientation, gender or identity will not be tolerated. Being part of this group requires mutual trust. Authentic, expressive discussions make groups great, but may also be sensitive and private. The Client agrees that what is shared in the group will stay in the group. All ideas and work shared in the group are protected by copyright law.
The Coach agrees that she shall not, without the prior written consent of the Client, disclose or use in any way, either during the course or thereafter, except to perform services as a Coach, any confidential business or technical information or trade secret acquired in the course of by the Client that is not in the public domain. The Coach covenants to use her best efforts to prevent the publication or disclosure of any trade secret or confidential information that is not in the public domain and that relates to the business or finances of the Client, or any their dealings, transactions or affairs which may come to her knowledge in the pursuance of her duties or employment.
The information obtained from the Coach is not a substitute for professional advice such as a lawyer, accountant, banker, appraiser, or therapist. The information provided by the Coach does not constitute legal advice nor is it intended to be. Business Coaching is not a substitute for engaging the services of a CPA or Attorney, when necessary. Any decisions you make, and the consequences thereof are your own. Under no circumstances can you hold the Coach liable for any actions that you take. You agree not to hold the Coach liable for any loss or cost incurred by you, or any person related or associated with you, as a result of materials or techniques, or coaching, offered by the Coach. Results are not guaranteed. The Coach holds no responsibility for the actions, choices, or decisions taken or made by the Client.
If these terms are not agreeable, do not engage the services. By purchasing this course and engaging the services of the Coach, the Client agrees to all the above terms and conditions.
